Terms.

The agreement between you and Construct when we work together.

1. The relationship

Construct ("we," "us") provides infrastructure services — custom builds, hosting, maintenance, email, and AI integration. You ("client," "you") pay a monthly fee for these services. This page describes the default terms. A signed statement of work overrides anything here that conflicts with it.

2. Infrastructure, not a server

We sell infrastructure, not a server. You are entitled to everything that keeps your business online: your website, email, hosting, backups, security, monitoring, AI integration (bring your own provider), status page, monthly report, and small content updates. These are part of your plan, not add-ons.

Additional services (content updates packs, priority response, custom feature development, rescue projects) are optional and quoted separately.

3. Pricing

Prices are quoted as a monthly recurring fee. The first 3 months may be charged at an introductory rate, with the regular rate applying from month 4 onward. Your monthly fee is locked for 12 months from the date of your first payment. After 12 months, we may adjust the fee with 30 days written notice.

There is no separate build fee. The monthly fee covers both the initial build and ongoing infrastructure, maintenance, and support.

4. Build phase

We typically start within 14 days of your first payment. We deliver a preview at a temporary URL. You have 7 days to review and request changes. One 7-day extension is included. We do not stop until you are satisfied with the result.

5. Go-live and billing

When you approve the build, we deploy to your domain and monthly billing begins. The first month is billed on go-live. Subsequent months are billed on the same date each month. Payments are processed by Stripe. You authorize recurring charges.

6. What you're entitled to (included in your plan)

  • Your custom website, built to match your business
  • Your custom business email (info@, support@, etc.)
  • Custom domain email service
  • SSL certificate
  • Hosting on our infrastructure
  • Daily encrypted backups (downloadable at any time)
  • Uptime monitoring
  • Security patches and updates
  • AI integration (you bring your own AI provider and API key)
  • Status page access
  • Monthly report
  • 1-business-day support response (email only)
  • Small content updates (text edits, photo swaps, bug fixes)

7. AI features (BYOAI)

Construct integrates your AI provider of choice (OpenAI, Anthropic, OpenRouter, Groq, or any API-compatible service) into your infrastructure. You provide the API key. You pay your AI provider directly based on their pricing. We do not add any markup or admin fee on AI usage. You may switch providers at any time; we will update the configuration at no cost.

8. Email

Your business gets the email it needs, at no extra charge. Email is part of your infrastructure, not a paid add-on.

9. Scaling (no overage fees)

Each tier has a natural fit (typical visitor count and account count). These are guidance, not hard caps. We do not charge overage fees or automatically upgrade you. When your usage grows significantly past the natural fit (roughly 2x), we will reach out and discuss options: upgrade tiers, optimize, or add capacity without changing your tier. The decision is yours.

10. Minimum commitment

The infrastructure subscription has a 3-month minimum. After the 3rd paid month, you may cancel with 30 days notice. We do not pro-rate refunds on the minimum.

11. Code ownership

After the 3rd paid month, the full source code for your project is transferred to an account you control. Documentation, runbooks, credentials, AI prompts, and infrastructure configuration are handed over. From that point, the code is yours. You may self-host, take it elsewhere, or hire another team.

12. The permanence promise

If Construct ever ceases operations, you keep everything. We will provide at least 90 days notice, a final handover package (code, credentials, docs, database export, AI configuration), and free migration support for 30 days. Your business does not depend on our business surviving. This is a binding commitment.

13. What we maintain

While you are an active subscriber, we patch security vulnerabilities, renew SSL certificates, run backups, monitor uptime, and respond to incidents. We maintain your AI integration (when provider APIs change, we update the configuration). We do not commit to specific response times unless stated in your statement of work.

14. What we don't do

We don't promise 100% uptime. We don't accept liability for client-side changes, third-party service outages outside our stack, or business losses from downtime. We don't work on projects that violate the law. We don't provide graphic design services (logos, branding, illustration).

15. Payment

Payments are processed by Stripe. You authorize recurring charges for the subscription. Failed payments are retried over 7 days. After that, services may be suspended. We will notify you before any suspension.

16. Confidentiality

Both parties keep the other's business information confidential. This survives the end of the engagement.

17. Disputes

We try to resolve disputes directly. If we can't, this agreement is governed by the laws of Jamaica. Disputes are subject to the exclusive jurisdiction of the courts of Jamaica.

18. Changes to these terms

If we change these terms, current subscribers get 30 days notice before they take effect. New terms apply to new engagements immediately.
